Visa Options for Family Migration

If you are an Australian or New Zealand citizen or resident and want to bring your close family members in Australia, you can sponsor them.

Partner Visas

Australian citizens and permanent residents can sponsor their partner for migration to Australia. A partner can be defined as a person to whom you are either married, in a de-facto relationship or have a registered relationship to be engaged.

One can apply for partner migration visa under following subclasses:

Subclass 820 and 801: Subclass 820 visa is temporary partner visa and is the first stage towards a permanent Partner visa- subclass 801. The applicant must be in Australia while applying and also at the time when this visa is decided.

The Partner (Provisional) visa (subclass 309) allows you to live in Australia if you are the spouse or de facto partner of:

  • an Australian citizen
  • a permanent resident
  • an eligible New Zealand citizen.

Subclass 309 and 100: Subclass 309 visa is temporary partner visa and is the first stage towards a permanent Partner visa- subclass 100. The applicant must be outside Australia while applying and also at the time when this visa is decided. The average time between the processing of two stages is about two years.

The Partner (Provisional) visa (subclass 309) allows you to live in Australia if you are the spouse or de facto partner of:

  • an Australian citizen
  • a permanent resident
  • an eligible New Zealand citizen.

Parent Visas

The parents who children are living permanently in Australia may be eligible for parent visa if they meet the balance-of- family test i.e. at least half of their children live permanently in Australia.

A person can apply for a parent visa under following subclasses

Subclass 143- Contributory Parent Visa: This visa lets parents live permanently in Australia if their child is an Australian citizen, permanent resident or eligible New Zealand citizen who lives in Australia.

To get this visa, the applicant must either:

  • hold a temporary Contributory Parent (Temporary) visa (Subclass 173)
  • have a child who is an Australian citizen, an Australian permanent resident or an eligible New Zealand citizen settled in Australia
  • meet the balance-of- family test
  • have an accepted assurance of support
  • meet health and character requirements.

Subclass 173 Contributory Parent (Temporary) visa: This visa is for the people who are the parents of an Australian citizen, permanent resident or an eligible New Zealand citizen settled in Australia. This visa lets the parents who are outside Australia live in Australia for up to two years.

To be able to get a Contributory Parent (Temporary) visa (subclass 173) the applicant must:

  • have a child who is:
    • an Australian citizen, an Australian permanent resident or an eligible New Zealand citizen
    • lawfully resident in Australia for at least two years (a shorter period can be considered for Australian citizens if there are compelling and compassionate circumstances)
  • have a sponsor
  • meet the balance of family test
  • meet health and character requirements.

Subclass 804- Aged Parent Visa: This visa is designed for older parents and lets them live permanently in Australia if they are parents of an Australian citizen, permanent resident or eligible New Zealand citizen who is settled in Australia.

Usually, the applicants need to be sponsored by their child.

  • Remaining Relative (subclass 835/115/)
  • Aged Dependant Relative (subclass 838/114)
  • Carer (Subclass 836/116)
